These Terms of Service ("Terms") govern your use of the RadGlow website and your communications with RadGlow LLC. By using the website, you agree to these Terms. If you do not agree, do not use the website.
1. Website purpose
The website provides general information about permanent outdoor lighting products and installation services and allows visitors to request information or a quote. Website content is informational and may be changed at any time.
2. Quotes and services
A website submission is only a request for contact or an estimate. It does not create an installation contract, guarantee availability, reserve an appointment, or bind either party. Pricing, scope, scheduling, payment terms, warranties, and other project-specific terms will be stated in a separate written proposal or agreement. If that agreement conflicts with these Terms regarding paid services, the signed agreement controls.
You agree to provide accurate contact and property information and to have authority to request services for the identified property.
3. Communications
By submitting a form, you authorize RadGlow and its service providers to contact you about your inquiry by email, telephone, or text at the information you provide. Consent to marketing is not a condition of purchase. Message and data rates may apply. You may opt out of marketing texts by replying STOP and of marketing emails through the unsubscribe link or by contacting us.
4. Acceptable use
You may use the website only for lawful personal or business inquiries. You may not interfere with the website, attempt unauthorized access, introduce malicious code, scrape or harvest information through automated means, impersonate another person, submit false information, or use website content in a way that infringes another party's rights.
5. Intellectual property
The website's design, text, graphics, logos, photographs, video, software, and other content are owned by RadGlow, its licensors, or their respective owners and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable right to access the website for its intended purpose. No other rights are granted. Gemstone Lights and third-party names or marks belong to their respective owners.
6. Third-party services and links
The website may use or link to third-party services. We do not control and are not responsible for third-party content, availability, security, or practices. Your use of those services may be governed by separate terms and policies.
7. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." RADGLOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CONTENT, PRODUCT DESCRIPTIONS, IMAGES, AVAILABILITY, OR ESTIMATES WILL ALWAYS BE COMPLETE OR CURRENT.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADGLOW AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM WEBSITE USE. OUR TOTAL LIABILITY FOR CLAIMS ARISING SOLELY FROM USE OF THE WEBSITE WILL NOT EXCEED $100.
These limitations do not apply where prohibited by law and do not alter obligations in a separate signed service agreement.
9. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold RadGlow harmless from claims, damages, and expenses arising from your unlawful misuse of the website, violation of these Terms, or infringement of another person's rights.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute arising solely from website use will be brought in the state or federal courts serving Sheridan County, Wyoming, and you consent to their jurisdiction, except where applicable consumer law requires otherwise.
11. Changes and general terms
We may update these Terms by posting a revised version and effective date. Continued website use after an update constitutes acceptance of the revised Terms. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and any applicable signed service agreement, constitute the relevant agreement between you and RadGlow.
